Welcome to Felicity IDC Limited. These Terms and Conditions ("Terms") constitute a legally binding agreement between you (the "customer") and Felicity IDC Limited, the authorized reseller of the Starlink Enterprise Internet Service.

By availing Starlink service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. These Terms apply in conjunction with our Privacy Policy, which governs how we collect, use, and protect your data. You must agree to both policies to use our services.

Felicity IDC Limited (FIDC) is a prestigious and highly accredited TIER-III data center located at Kaliakair Hi-Tech Park (KHTP), Kaliakair, a sole proprietorship registered in KHTP (Kaliakair), Bangladesh.

Felicity IDC Limited (FIDC) delivers colocation, Private Cloud (IaaS) Service, SOCaaS, Datacenter consultancy and Starlink Enterprise Internet services as an authorised reseller of Starlink.

2. Eligibility

To qualify for Starlink Enterprise service, you must sign up for a Starlink Enterprise Plan (Mini, Standard or High Performance), and be registered as a valid and authorised business entity in Bangladesh.

2.1 Local Legal Compliance

You are solely responsible for ensuring that your use of the Starlink Enterprise Internet Service complies with regulatory requirements of Internet usage as implied by the Bangladesh Telecommunication Regulatory Commission (BTRC). Felicity IDC Limited does not provide legal or regulatory advice under specific jurisdictional frameworks.

3. Account Validation

To obtain Starlink Enterprise Internet service, you must sign an agreement with Felicity IDC Limited by providing all valid business information as requested by Felicity. You are responsible for all activities of Internet usage under your business profile.

You agree to notify us immediately of any unauthorized use or suspected breach of security related to your account and/or service.

3.3 Accuracy of Information

You agree to provide accurate, complete, and current information when signing up and agreeing with Felicity IDC Limited for Starlink Enterprise Internet Service. You are solely responsible for ensuring that provided documents and business information are correctly attributed and up to date. Felicity IDC is not liable for any issues arising from inaccuracies in your submitted data.

4. Subscription Plans and Payments

Please visit Felicity website (https://felicity.net.bd) or talk to Felicity Business Team for available plans and pricing.

4.1 Billing and Payment Processing

Payments for subscriptions or premium features are processed through third-party payment gateway such as SSLCOMMERZ or wire transfer. By subscribing, you authorize these platforms to charge your selected payment method in accordance with their terms.

Felicity IDC Limited does not store or process full credit card information and is not responsible for payment issues originating from third-party processors.

Felicity IDC Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of hardware damages.

6.3 Additional Limitations and No Compensation Policy

Felicity IDC Limited shall not be liable for any compensation, refund, or damages resulting from temporary or permanent service disruption, data corruption, or data loss due to third-party technology failures.

7. Force Majeure

Felicity IDC Limited shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters (e.g., earthquake, tsunami, flood).

7.1 User Responsibility for Misuse

You must indemnify and hold harmless Felicity IDC Limited against any claims arising out of misuse, violation of terms, or applicable laws.

7.2 Hold Harmless Clause

Felicity will not be held responsible for damages or liabilities resulting from failure to comply with these Terms or unauthorized use of the service.

7.3 Notice of Changes
7.4 Continued Use as Acceptance

Continued use of the service after changes constitutes acceptance of the updated Terms. If you disagree, notify Felicity and request termination.

8. Jurisdiction (Bangladesh)

These Terms shall be governed by the laws of the People’s Republic of Bangladesh.

8.1 Informal Resolution Process

You agree to attempt resolution via informal negotiation before initiating legal proceedings. Contact us via email with issue details.

8.2 Legal Remedies and Arbitration (if applicable)

Unresolved disputes may be taken to courts in Dhaka, Bangladesh. Felicity IDC Limited may opt for arbitration.
